What are the benefits of a contingency fee?
Most personal injury attorneys handle injury cases on a contingency fee basis because accident victims either cannot or prefer not to have to pay an hourly fee and advance all case expenses for their case. If you are injured in an accident and already suffered damages like medical expenses and lost wages, you probably would prefer not to pay an attorney hourly and take on the risk and uncertainty of what a potential recovery might be from the insurance company.
As a result, personal injury cases are typically handled with a contingent fee agreement whereby a lawyer is paid a certain percentage of the total recovery that is agreed to up front by the client. A contingency fee arrangement shifts the risk of the case to the law firm as well as aligns the interests of the attorney with the client in order to maximize recovery.
Our contingent fee agreements include case expenses, litigation costs and court fees, which means our law firm advances all these costs for our injury clients. These expenses can include the lawsuit filing fee, expert witness fees, deposition and mediation costs, costs for medical records, and other such expenses. Again, this shifts the risk of recovery in the suit from the law firm to the client because, if there is no award through settlement or judgment, our will receive no fee and no reimbursement of these costs.
